Contact us through the contact form or at the postal address above. Read these Terms and the Privacy Policy before using the service. By creating an account or affirmatively accepting these Terms, you agree to them to the extent a valid agreement is formed under applicable law. Merely reading the Privacy Policy is not consent to marketing, analytics or advertising.
1. Eligibility and account security
Account, community and email-update features are for users aged 13 or older. If you are below the age of legal majority where you live, obtain a parent or guardian’s permission and have them review these Terms. Do not create an account or submit an email if you are under 13.
Accounts are free and optional. You are responsible for choosing a lawful public username, safeguarding your passkeys and recovery codes, and activity you authorize through your account. Use only sign-in services and email addresses you control. Tell us promptly if you suspect unauthorized access. An email-update address does not replace a passkey or recovery code and cannot recover an account. Do not impersonate someone else or sell, share or trade account access.
2. Use of the service
You may browse the library and use the features offered for personal, lawful purposes, subject to the rights of content owners. Do not introduce malware, evade security or access restrictions, attack the service, harvest personal information, automate abusive traffic, send spam, interfere with other players or manipulate ratings and high scores. Accessibility tools and ordinary search indexing are not prohibited merely because they use automation, provided they respect access controls and do not disrupt the site.
We may investigate abuse, moderate contributions, withhold suspicious scores or restrict accounts when reasonably necessary to protect the service, comply with law or enforce these Terms. Where appropriate and lawful, you can ask us to review a decision through the contact form. You can stop using the site and delete your account in Settings.
3. Games, software, artwork and third-party rights
Game software, artwork, trademarks, character designs and other third-party materials belong to their respective rightsholders. Listing a game, calling it a classic or making a player available does not mean copyright has expired, make it public domain, or grant a rightsholder’s license. A game’s age, availability or “abandonware” description is not permission to copy or distribute it. You are responsible for having any rights or permissions required for your use and downloads. We do not authorize infringement.
Our original website materials may be used to access the service; no ownership is transferred. Open-source components remain subject to their own licenses, including EmulatorJS under GPL-3.0; see About and credits. Nothing in these Terms restricts rights granted by those licenses. Third-party links and advertisements are not an endorsement or a promise about their products.
Rightsholders can use the copyright-reporting page to report material, identify the work and location and supply the required information. We review valid reports and may remove or restrict material. The presence of that form is not a claim that any particular statutory safe harbor applies. Do not file knowingly false reports.
4. Profiles, comments and scores
You retain any rights you hold in your contributions. By submitting them, you grant us a nonexclusive, royalty-free permission to host, reproduce, display and technically adapt them only as needed to operate, secure and moderate the features you use. We do not obtain a right to sell your personal information. The permission ends when the contribution is removed, except for limited backups, legal obligations and copies already lawfully made by others.
Submit only material you may lawfully share. Do not post private information about others, unlawful material, threats, harassment, hateful abuse, spam or infringing content. Public posts can be seen and copied by other visitors. Player cards are optional; your email address is never part of your card. Scores may be reviewed and are not a guarantee of a prize, competition eligibility or independent verification.
5. Optional email updates
Email is not required for an account or gameplay. If you provide an address for updates, you must own or control it, confirm that you are at least 13, accept these Terms, acknowledge the Privacy Policy and separately choose to receive Back2OldGames news, new games and site updates. All consent boxes start unchecked. We record the choice, wording, date, source and policy versions. No existing account is subscribed merely because it already exists or signs in through another service.
We do not sell or rent the mailing list or let advertisers use it for their own marketing. We may use a delivery provider acting on our behalf. Each marketing message must identify its sender, use a truthful subject, include our valid postal address and offer a clear, free way to unsubscribe. Unsubscribing requires no login and stops future inclusion in our recipient list immediately. You can also remove the address in Settings without deleting your account. Essential replies to a request you send us are separate from optional marketing.
6. Availability and disclaimers
Games and features may change, become unavailable or work differently across browsers and devices. We do not promise uninterrupted access, accuracy of every catalogue detail, preservation of browser-local saves or compatibility with every game. Keep your own lawful backups of save files and account recovery information. Where lawful, the free service is provided “as is” and “as available”, without additional warranties, including implied warranties of merchantability, fitness for a particular purpose and noninfringement. Mandatory consumer guarantees are unaffected.
7. Responsibility and limits of liability
To the extent permitted by applicable law, we are not liable for indirect or consequential losses, lost profits or loss of browser-local save data resulting from use or unavailability of the free service. These limits do not exclude liability that cannot lawfully be excluded, including fraud, intentional misconduct or other nonwaivable obligations. No term waives statutory privacy rights or remedies. Some states do not allow some exclusions; those exclusions apply only to the extent lawful in your case.
8. Applicable law and resolving concerns
Colorado law and applicable U.S. federal law govern these Terms, except where mandatory law where you live requires otherwise. Please contact us first to try to resolve a concern. There is no mandatory arbitration clause or class-action waiver in these Terms. Nothing prevents a complaint to a regulator, a lawful claim in small-claims court or use of any court and remedies available under applicable law.
9. Changes and contact
We publish changes with an updated date and give appropriate notice of material changes. Where renewed agreement or consent is required, we ask for it. Changes do not retroactively authorize email marketing or remove rights that law preserves. If a provision is unenforceable, the remainder applies to the extent lawful. These Terms and the Privacy Policy do not replace third-party software licenses.
